The Family Law Section provides information to its members and the public about attorneys who practice in the areas of divorce, parenting and timesharing matters, adoption, prenuptial and postnuptial agreements, and modification and enforcement of judgments, including those which involve alimony and child support. Family law includes the legal issues which arise from the relationships of husband and wife and parents and children, and the litigation and resolution of civil controversies which are brought forth as a result of those relationships. Marital and family law includes evaluating, managing, and resolving these conflicts before the institution of lawsuits, both pre- and post-judgment, as well as the pretrial and trial process.
Why hire a Board Certified attorney
WHAT DOES IT MEAN?
Board Certified lawyers have met The Florida Bar’s highest standards for special knowledge, skills and proficiency in various areas of law and ethics in practice. A Certified lawyer’s experience and competency have been rigorously evaluated. Board Certification stringent requirements for legal expertise and professional conduct give the public objective standards by which to evaluate attorneys.
Marital and Family Law lawyers deal with legal problems and civil suits arising from the family relationships of husbands, wives, parents and children. Marital and Family law includes pretrial and trial processes and handling and resolving controversies before, during and after the filing and resolution of lawsuits.
When you hire a board certified marital and family law attorney, you are represented by an individual who has:
Met the requirements for board certification;
Practiced law for at least five years, with 50 percent or more dedicated to marital and family law cases in circuit courts during the five years immediately preceding application, including at least seven trials;
Been substantially involved in interviewing clients, counseling, preparing pleadings, discovery, taking testimony, preparing evidence, negotiating settlement agreements and handling the trial of marital and family law cases, including appeals; been evaluated for competency and professionalism by judges and peers;
Completed the required amount of continuing legal education;
Passed a written examination demonstrating knowledge,skills and proficiency in the field of marital and family law to justify the representation of special competence in this area of law to the legal profession and to the public.
Choose your divorce attorney wisely.
BE ADVISED that not all attorneys who handle divorce-related matters are Board Certified by the Florida Bar. Your decision to choose a Board Certified attorney over a non-specialist is one requiring serious deliberation. It may affect the outcome of your divorce and the lives of your children and grandchildren.
According to the Florida Bar Association, there are approximately 93,000 attorneys in Florida. The total number of attorneys who are Florida Board Certified in Marital and Family law (including yours truly) is just 253.
Interview more than one attorney.
This is the smartest way to compare and contrast the personality and energy of the attorney to whom you will pay good money to draw up the terms of your divorce; the individual whose work product will affect you long after the papers are signed. While you are interviewing potential attorneys, a competent attorney will be interviewing you as well. He or she does not need your case, but will elect to work with you for a variety of reasons. For me, this is based on the passion and energy YOU bring to the table.
